This is a Declaration of Covenants, Conditions and Restrictions for Hidden Hollow, a standard single-family homeowners association (HOA) in Durham, NC. It governs the lots and common areas and binds all lot owners, who automatically become members of the HOA.
- Land use & single-family requirement: Each lot is for single-family residential use only. Occupancy by more than three unrelated people is not considered a single family, so unrelated roommates are limited to three unless they are related by blood, marriage, or adoption.
- Dwelling size & location: Any new home must have at least 950 square feet of heated area (excluding decks, porches, basement, garage). Minimum setbacks: 25 feet from the front lot line, 8 feet from interior side lot lines, and 25 feet from the rear lot line.
- Architectural review: No exterior construction, alteration, or addition (including fences, walls, and screens) may be done without prior written approval from the Declarant or the HOA's Architectural Committee. Plans not approved or disapproved within 45 days of submission are deemed approved.
- Pets & animals: Dogs, cats, and other household pets may be kept, but animals, livestock, or poultry may not be raised, bred, or kept for any commercial purpose.
- Parking & vehicles: The HOA board may make rules prohibiting parking of recreational vehicles, boats, trailers, trucks, and commercial vehicles on common areas, driveways, front yards, or streets. Vehicles parked on the property must have valid license plates, and the board can limit on-premises vehicle repairs.
- Signs & antennas: No advertising signs or billboards are allowed, except one for-sale or for-rent sign no larger than 5 square feet. Television antennas and satellite dishes may only be placed in rear yards, screened from view.
- Assessments & fees: Each lot owner pays annual assessments (initially up to $40 per lot, adjustable annually by up to 7% or CPI) and may be subject to special assessments for capital improvements. Unpaid assessments bear interest up to 12% and become a lien on the property.
- Maintenance obligations: The HOA maintains the common areas. Each lot owner must keep their lot and home neat and orderly; if they don't, the HOA may step in after 30 days' notice and bill the owner for costs.
