Fieldstone is a standard single-family homeowners association (HOA) in Durham, NC. This document sets the rules for homeowners who own a lot in the subdivision; it does not apply to renters directly. The HOA maintains common areas and enforces covenants that run with the land.
- Membership & voting: Every lot owner is a member with one vote per lot. The developer (Declarant) had up to 6 years of Class B voting control with 3 votes per lot, which ended by December 31, 1998 or when Class A votes equaled Class B votes. Lot owners can delegate their common-area use to household members, tenants, or contract purchasers.
- Assessments (dues): Annual assessments began July 1, 1991, with a maximum of $120 per lot per year ($10/month). After 1992, the HOA board can increase the annual assessment up to 5% per year without a vote; exceeding 5% requires a 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 approval. Assessments are uniform per lot except Class B (developer) lots pay 50%. Unpaid assessments become a personal debt and a lien on the lot, subject to foreclosure and 6% annual interest.
- Common area & easement: Every owner has an easement to use the common areas (described in Schedule B). The HOA can charge reasonable fees, suspend voting/use for unpaid assessments (for up to 60 days for rule violations), and mortgage or transfer common areas only with 2/3 member approval. Owners may delegate their use to occupants, tenants, or contract purchasers.
- Enforcement & amendments: The HOA or any owner can enforce the covenants through legal proceedings. Failure to enforce does not waive future enforcement. The covenants automatically renew every 10 years after the initial 20-year term. Amending the declaration during the first 20 years requires 90% of lot owners; after that, 75% approval is needed.
