Asbury Place is a standard single-family homeowners association (HOA) in Clemmons, NC. The rules apply to landowners (lot owners). As a resident, you own your lot and house, while the association maintains shared common areas and may maintain exteriors of homes. You must comply with use restrictions, obtain architectural approval for changes, and pay assessments that can become a lien on your property.
- Lot & dwelling requirements: Lots are for single-family residential use only. One-story dwellings must have at least 1,450 square feet of heated/ finished floor space; 1½-story or 2-story dwellings need at least 1,650 square feet. Maximum two stories allowed. Construction must be completed within six months.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 10% per year without member vote. Special assessments for capital improvements require a majority vote of each membership class. Unpaid assessments accrue 15% annual interest (or max legal rate) and become a lien on the lot.
- Architectural review: No exterior construction, alteration, painting, or fencing may begin without prior written approval from the Architectural Review Board (or Declarant initially). Submit two sets of plans; the Board may withhold approval for any reason, including aesthetics. Unapproved work can be stopped and corrected at the owner's expense.
- Parking & vehicles: No commercial vehicles or trucks with more than four tires (except for loading/ construction). Boats, trailers, motor homes, and off-road vehicles may not be parked on lots or common areas. No motor vehicle repair (except routine maintenance) on common areas. No parking in fire lanes.
- Use restrictions & nuisances: Lots may not be used for any business or commercial purpose. No livestock, poultry, or outside animal lots — only standard household pets (leashed in common areas). No outside clothes drying except limited weekday/ Saturday hours. No above-ground pools except children's wading pools. Prohibited: firearms, fireworks, inoperable vehicles, and unsightly stored materials.
- Maintenance responsibilities: The association maintains common areas and may also maintain exteriors (roofs, gutters, paint) of homes after notice to the owner — at the owner's cost plus up to 15% admin fee. Owners maintain interior and all improvements on their lots. Owners must maintain hazard insurance (min. $250,000 liability) and name the association as additional insured.
- Leasing & rentals: The document does not impose any minimum lease term, rental cap, or require association approval to lease. The declaration is silent on leasing beyond referencing tenants' rights to use common areas.
