What Yorkshire's governing documents say
Yorkshire is a single-family home subdivision in Charlotte, NC, governed by a homeowners association (HOA). These documents are a rescission of an earlier amendment and several layers of recorded covenants and amendments that together define the subdivision's rules. The main rules establish minimum square footages for homes, architectural review requirements, and an annual assessment fee.
- Minimum home size: Minimum heated area varies by phase and lot: Phase I lots 1–16 require 1,750 sq ft; lots 17–22 require 2,700 sq ft; lots 23–42 require 2,000 sq ft. Phase II requires 2,000 sq ft (the 1,900 sq ft and 2,000 sq ft figures in later amendments apply only as noted in those filings). The architectural review committee can permit smaller dwellings in individual cases.
- Exterior materials: Residential structures must have at least 70% of exterior finish in brick, stone, or stucco (from the 2000 amendment, which was later rescinded — so this requirement may not currently apply. Check the current status of that amendment.)
- Architectural review: All construction, exterior changes, and color changes require written approval from the Architectural Review Committee (ARC). Plans must be submitted; approval or disapproval is given within 15 days. A fee may be charged. Fences and accessory buildings also need ARC approval.
- Assessments & fees: Annual assessment is $95 per owner (unimproved lot or dwelling unit), due January 1. A one-time $100 special assessment is due before building approval. Annual increases up to 10% can be set by the board; larger increases require a majority vote of members.
- Violations & penalties: If a violation is not fully corrected within 30 days of notice, a $50-per-day special assessment may be imposed in addition to any other legal remedy.
- Use restrictions: All lots are for single-family residential use only. No mobile homes, modular homes, or prefabricated dwellings. No commercial activity, no nuisance, no above-ground pools, no inoperable vehicles or unlicensed vehicles, no boats/trucks/campers/motor homes parked on streets or in front yards.
- Construction & completion: Construction must be completed within one year of starting. During construction, debris must be removed weekly, drives must be graveled, and streets must be cleaned daily.
