What Beacon Hills's governing documents say
Beacon Hills is a single-family home subdivision in the Charlotte, NC area governed by a recorded set of protective covenants. These rules run with the land and bind all current and future homeowners in the subdivision. This is a partial collection of several documents, including the original 1977 restrictions, later amendments adjusting setbacks for specific lots, and unrelated deeds, so it does not provide a complete rulebook for the community.
- Residential use only: Every lot must be used only for a single-family dwelling, with one detached house (max 2.5 stories) and a two-car private garage.
- Minimum house size & quality: Dwellings must cost at least $12,000 to build (based on 1977 cost levels). The ground floor area must be at least 1,150 sq. ft. for a one-story house or 750 sq. ft. for a multi-story house, excluding open porches and garages.
- Lot & setback requirements: Each lot must be at least 10,000 sq. ft. with a minimum width of 70 ft. at the building setback line. The front setback is 30 ft., side street setback is 20 ft., and interior side setback is 10 ft. Eaves, steps, and open porches don't count toward setbacks. Individual lots may have adjusted setbacks by amendment.
- Architectural approval: Construction plans, specs, and a location plan must be submitted to and approved in writing (originally by the developer) before any building can be built or altered on a lot.
- Easements & utilities: Utility and drainage easements exist as shown on the recorded plat, plus along the rear 10 ft. of each lot. No structures, plantings, or materials may interfere with utilities or drainage in these easements.
- Nuisance & offensive activity: No noxious or offensive activity is allowed on any lot, and nothing may become an annoyance or nuisance to the neighborhood.
- Temporary structures & outbuildings: No trailer, tent, shack, basement, garage, barn, or other outbuilding may be used as a residence, even temporarily.
- Signs: Only one professional sign of up to 1 sq. ft., one 'for sale/rent' sign of up to 5 sq. ft., or builder signs during construction/sales are allowed.
