Wellington Ridge is a condominium community in Cary, NC — you own your unit and share ownership of the common elements, which the association maintains and insures. This document is a set of governing documents (Articles of Incorporation, Bylaws, and Declaration of Condominium) that establish the rules for owners, residents, and the association. The association is run by a board of directors, manages assessments, and enforces rules. The documents also reserve special rights for the developer during a control period.
- What you own & maintain: You own the interior of your unit (up to the undecorated surfaces of walls and subflooring). The association maintains, repairs, and replaces the common elements — including limited common elements assigned to specific units — and pays for this through common expense assessments on all units.
- Leasing & rentals: Rentals for less than 30 days or with hotel services are prohibited. Leases must be in writing, cover the entire unit, and require the owner to notify the association of tenant details. Subleases need board approval. An owner remains fully responsible for all obligations even if the unit is rented.
- Pets: No more than two dogs, two cats, or a total of three household pets are allowed at any time. Pets must not be kept for commercial purposes. The board can ban any pet it deems a nuisance.
- Design & alterations: Unit owners must get board approval before altering unit boundaries, removing partitions, or making changes that affect structural integrity or mechanical systems. The process includes submitting plans, a board hearing, and a possible appeal to the full membership. No one may alter common elements without written board permission.
- Assessments & fees: The board prepares an annual budget and levies assessments, which become a lien on the unit. Assessments are generally paid in 12 monthly installments. Delinquent assessments accrue interest, and the association can foreclose or get a money judgment. The board can also levy special assessments, with membership approval required if the amount exceeds $25,000.
- Voting & membership: Every unit owner is a member and gets one vote per unit owned. The developer had three votes per unit during the declarant control period (ending by January 1, 1999, or earlier conditions). A 50% quorum is needed for member meetings, and most questions are decided by a majority of votes cast.
- Use restrictions & noise: Units are for residential use only. No hazardous, noxious, or offensive activities are allowed. Outside antennas and satellite dishes require board permission. Owners must not increase insurance rates or cause waste (damage) to their unit or common elements.
- What this document doesn't cover: This set of documents does not address parking rules, amenity hours, specific rental caps or owner-occupancy requirements, age restrictions, or architectural review procedures beyond unit alterations. Those topics may be covered in separate rules and regulations adopted by the board.
