Village Core is a mixed-use planned community in Cary, governed by a master homeowners association under the North Carolina Planned Community Act. This declaration establishes the rules, assessments, and architectural controls that apply to all residential and commercial lots, and it allows for sub-associations to impose additional rules.
- What you own & maintain: Owners of residential lots (single-family, townhome, or condo units) must maintain their lot and structures, except for exterior walls, roofs, and foundations that a sub-association may cover. The association maintains common areas, road medians, and streetlights.
- Architectural review: No exterior changes, fences, signs, or new buildings may be built without prior written approval from the Architectural Review Committee (ARC). The ARC has 45 days to respond; if no reply, plans are deemed approved.
- Assessments & fees: The association levies regular and special assessments on each lot. Special assessments require a majority vote of members. Unpaid assessments accrue interest up to 18% per year, plus a late fee of $20 or 10% of the unpaid amount, and can become a lien foreclosable like a deed of trust.
- Leasing & rentals: Leases must be in writing and require tenants to comply with the declaration and rules. Tenants must acknowledge receipt of use restrictions.
- Parking & vehicles: Residential parking spaces are assigned by the declarant; commercial owners and their permittees may not park in them. No trucks, boats, trailers, RVs, or campers may be visible from any street or lot unless stored in an enclosed garage.
- Use restrictions: Residential lots cannot be used as rooming houses, hotels, or for transient purposes. No outside clotheslines visible from the street, no window air conditioning units, and no livestock except reasonable household pets (number set by board).
- Signs: For-sale or for-rent signs cannot exceed 3 by 2 feet; all other signs require ARC approval. Exceptions include security signs up to 6 by 6 inches and approved commercial signage.
