Chatham Pointe is a planned community of townhome units in Cary, NC — you own your unit and the land it sits on, and you share ownership of the common areas (including a greenway path) through a mandatory homeowners association. This is the full set of covenants, conditions, and restrictions that run with the land and bind all owners, residents, and tenants.
- What you own & maintain: You own your townhome unit and the lot underneath it. The association maintains the common area, private streets, street lighting, and exterior building surfaces (roofs, gutters, paint, siding). You are responsible for everything else: interior, windows, doors, garage, decks, driveways, fences, landscaping inside any fence on your lot, and exterior window coverings.
- Leasing & rentals: Leases must be for at least six months; only entire units may be rented (no subleases). You must provide a copy of the lease to the association, and all leases must include the tenant's agreement to follow the community rules. The association can evict tenants if either the tenant or owner violates the rules or if association liens are foreclosed.
- Pets: No more than two domesticated household pets per unit, and no pet may weigh more than 100 pounds. No commercial breeding or raising of animals, livestock, or poultry.
- Parking & vehicles: Vehicles must be parked in your garage or driveway; street parking is only allowed in designated paved spaces. No boats, RVs, campers, trailers, or commercial vehicles may be kept overnight or for more than 10 hours on any street or common area. The association may tow violators at the owner's expense.
- Use restrictions: Units are limited to single-family residential use only. No more than one family or two unrelated individuals per bedroom may occupy a unit; transient guests are limited to 30 days per year. No business, commercial activity, or obnoxious uses are allowed. Window treatments visible from outside must be white unless otherwise approved.
- Architectural review: All exterior changes (including fences, landscaping, paint, and structures) require prior written approval from the Architectural Committee. Satellite dishes and antennas under one meter may be installed without pre-approval but must be placed on the rear of the house or yard to minimize visibility. New homes must be at least 1,800 heated square feet.
- Homeowner voting & board control: Each lot gets one vote. The developer (Declarant) gets 10 votes per lot it owns and can appoint the board during the Declarant Control Period, which ends by December 31, 2030 or when all lots are sold, whichever comes first.
