What Lion Mountain Owners Association's governing documents say
Lion Mountain Owners Association is a non-profit corporation that manages the common areas in Lion Mountain Subdivisions #1 and #2 near Whitefish, Montana. It is a standard HOA for a single-family subdivision, so owners of lots in the subdivision are members and pay assessments to maintain shared property.
- Membership & voting: Every owner of a lot (including contract purchasers) is a member. Each lot gets one vote, but owners of a lot must agree on how to cast it. Members can cumulate votes in director elections.
- Board of directors: The board has five directors, who need not be members. Until 80% of lots are sold by the developer, the developer appoints at least three directors. All directors are elected annually.
- Special decisions & dissolution: A two-thirds vote of members is required to dedicate, sell, or transfer common area to a public agency. Upon dissolution, assets go to a public agency or a similar non-profit.
- Powers of the association: The association may fix and collect assessments, borrow money, mortgage property, purchase or sell real estate, annex additional property, and exercise all powers under Montana non-profit law.
- What this document doesn't cover: These articles of incorporation establish the corporation itself. They do not contain rules on pets, leasing, architectural standards, parking, or specific fee amounts — those would be in the Declaration of Covenants, Conditions and Restrictions referenced here.
