The Villages of Kirkwood is a townhouse community in Lexington, KY, run by a homeowners association (HOA). Each owner owns a lot and a townhouse unit, and shares responsibility for party walls and common areas, which the HOA maintains. The governing document is a Declaration of Covenants, Conditions and Restrictions that runs with the land and applies to all current and future owners.
- What you own & maintain: You own your lot and townhouse unit, including the interior, entry doors, windows, and interior systems. The HOA maintains roofs, exterior surfaces, gutters, downspouts, and all common areas (landscaping, driveways, walkways, parking areas). Party walls are shared and insured by the HOA; repair costs not covered by insurance are split between the owners who use that wall.
- Use restrictions: Units are for residential use only. No commercial vehicles, trucks, trailers, boats, RVs, or unlicensed vehicles may remain overnight. No major vehicle/boat repairs on lots. No animals except household pets (dogs, cats) kept inside; pets must be kept within the fenced courtyard or on a leash in designated common areas. No outdoor drying of clothes except in the fenced courtyard. No gardens outside the courtyard. No outside pools, games, or nets. No trees may be cut without Board permission.
- Architectural review: No building, fence, wall, or other structure, and no exterior changes or additions, may be made without prior written approval from the Board or an architectural committee. Plans showing design, materials, and location must be submitted; if not approved or disapproved within 60 days, approval is deemed granted. All exterior color changes also require advance Board approval.
- Parking & vehicles: Vehicles must be parked in designated paved parking areas. No private trucks, trailers, recreational vehicles, boats, campers, or commercial vehicles may remain overnight in the community.
- Assessments & fees: All owners pay annual assessments to cover common expenses, insurance, and maintenance. Special assessments may be levied for capital improvements or extraordinary repairs. Assessments become a lien on the lot if unpaid, with 12% annual interest and collection costs, including attorney fees. The annual assessment is set by a vote of more than 50% of members; special assessments for capital improvements require the same approval.
- Insurance: The HOA carries blanket all-risk casualty insurance on all townhouse units and the common area, plus liability insurance with at least $1,000,000 combined single limit. Owners must also carry their own insurance on their units unless the HOA's policy covers them. The HOA's Board has exclusive authority to adjust insurance claims, but mortgagees may participate in settlement negotiations.
- Amendments & duration: The covenants run for 25 years from 2014 and automatically renew for 10-year periods. Amendments require a vote of at least two-thirds of all lot owners. The restrictions can be enforced through legal action or by placing a lien on the lot.
