This is the Declaration of Easements, Covenants, Conditions and Restrictions for The Greens of Chapel Creek, a single-family home subdivision in Shawnee, Kansas. The document binds all lot owners (and future owners) to a set of rules designed to maintain a high-quality residential community, and it grants the homes association broad powers to manage common areas and enforce restrictions.
- What you own & maintain: You own your lot and the residence on it, and you are responsible for maintaining the exterior, landscaping, and keeping the property neat. The association maintains common facilities (parks, green space, drainage, etc.) and may also maintain the landscaping within certain restricted areas on your lot.
- Architectural review: Before any construction, landscaping, fence, exterior painting, or other alteration (including replatting), you must get written approval from the Architectural Committee. The committee can reject plans that don't meet design standards (including minimum square footage: 2,000 or 2,500 sq ft for ranch homes, 2,500 or 3,100 sq ft for two-story homes, depending on the section).
- Use & occupancy restrictions: Lots are for residential use only. Occupancy is limited to one family (persons related by blood, marriage, adoption, or up to two unrelated persons living as a single housekeeping unit). No duplexes, apartments, rooming houses, group homes, or commercial uses are allowed.
- Pets & animals: No more than three domesticated household pets per lot. Animals must be confined to your fenced backyard (or by invisible fence) or inside the home. Dog runs are not permitted, and you must keep the lot free of pet waste. No livestock, poultry, or exotic animals are allowed.
- Parking & vehicles: Boats, RVs, trailers, campers, and trucks over one ton must be stored inside an enclosed garage. Street parking is prohibited except for temporary guest parking. Vehicles cannot be stored on driveways (must be driven at least once every 10 days). No major vehicle repairs are allowed outside the garage.
- Fences & structures: Fences are not encouraged. On non-golf-course lots, only wrought iron fences up to 4 feet tall are allowed, and they cannot extend closer to the front street than the rear corners of the residence. On golf-course lots, no fences on property lines are permitted except pool safety fences. All outbuildings (sheds, greenhouses, etc.) require committee approval.
- Leasing & rentals: Renting is allowed, but the owner remains jointly responsible with the tenant for all covenant violations. The lease must comply with the occupancy limits (one family). No term length restrictions are stated, so any lawful lease is permitted.
