Westmore Downs is a standard single-family-home HOA in Kansas City, Kansas. These rules bind the homeowners of lots 1-38 in the subdivision. The HOA maintains common areas and enforces the restrictions to protect property values.
- Land use & lot use: Lots may only be used for private single-family residence purposes. No flats, apartments, or commercial activity is allowed. One professional sign of up to 120 square inches (or an 8-foot-square sale sign) is permitted.
- Building & architectural review: All new construction, fences, walls, swimming pools, and exterior changes must be approved in writing by the Architectural Control Committee (or Board) before work begins. Plans showing design, height, materials, and location must be submitted; the committee has 30 days to approve or disapprove.
- Minimum home size & height: A one-story or split-level home must have at least 1,200 square feet of finished living area (excluding garage, breezeway, basement). A two-story home must have at least 850 sq ft on the first level and 1,450 total. No residence may exceed two levels above ground in front.
- Pets & livestock: No livestock or poultry may be raised or kept. Dogs, cats, and other household pets are allowed, but no more than two dogs, two cats, or a combination thereof may be kept on a lot without the Architectural Control Committee's consent. Pets cannot be kept for commercial purposes.
- Parking & vehicles: No trucks, buses, commercial vehicles, boats, trailers, campers, or similar vehicles may be parked or stored on a lot unless inside an enclosed garage (except for temporary service and delivery parking). No overnight parking on adjoining streets is allowed. Automotive repairs must be done inside the garage.
- Fences & exteriors: No fence may be installed without prior approval. Fences are not allowed in front of the rear wall of the residence; on corner lots, the side-yard fence may not extend beyond the side of the house. Garage doors must be kept closed as much as possible.
- Assessments & fees: The HOA levies annual assessments (with a 15% per year increase cap without a 2/3 member vote, and larger increases require a 2/3 vote). Special assessments for capital improvements also need a 2/3 vote. Assessments are due by March 1 or within 30 days of mailing; unpaid amounts bear 10% annual interest and become a lien on the property.
