Hickory Springs (sections 1 and 2) is a standard single-family home subdivision in Monrovia, Indiana, governed by a homeowners association (HOA). These covenants run with the land and apply to all lot owners, setting requirements for construction, appearance, and use of each lot.
- Architectural review: All building plans, site plans, and exterior changes (including fences) must be approved by an Architectural Review Committee before construction or installation. Plans must show septic field location and be certified by an engineer or surveyor. Approval may be unreasonably withheld.
- Minimum house size & materials: For Section 1: a one-story house must have at least 2,200 sq ft of ground floor area (if higher than one story, at least 1,400 sq ft on ground floor plus 800 sq ft upper, total 2,200 sq ft). - Roof pitch & garage: Main roof pitch must be at least 10:12 (10 inches vertical per 12 inches horizontal). Section 1 requires a minimum three-car garage; Section 2 requires a minimum 600 sq ft three-car garage.
- Pets & animals: No livestock or poultry allowed. Customary pets (dogs, cats, etc.) are permitted inside the dwelling but not for commercial purposes; no outdoor pens. Pets outdoors must be leashed and attended, and the owner is liable for any damage or injury.
- Parking & vehicles: Boats, campers, trailers, buses, mobile homes, RVs, and trucks over ¾ ton may not be parked on roadways or driveways visible to the public unless permitted. No vehicle repair work allowed in the subdivision. Recreational vehicles (mopeds, motorcycles, four-wheelers) may only be operated to enter/leave the subdivision.
- Fences & pools: Only in-ground swimming pools permitted (no above-ground). Section 1 requires a minimum 5-ft privacy fence around pools; Section 2 requires a minimum 6-ft fence. All fences need ARC approval, must be two-sided (neighbor-friendly), made of wood, masonry, or wrought iron, and located only in the backyard (no chain-link allowed).
- Lot maintenance & other restrictions: Grass must be kept under 6 inches tall. Vegetable gardens limited to 400 sq ft in the rear yard. No open burning; trees 8 inches or larger in diameter cannot be removed without ARC approval. No firearms (including air rifles, pellet guns) allowed. Sidewalks must be installed by the lot owner along their street frontage (4-ft wide, 1 ft inside right of way).
