Wingfoot Park is a standard single-family homeowners association (HOA) in Cartersville, Georgia. The HOA's governing document, the Declaration of Covenants, Conditions, Restrictions and Easements, applies to all owners of lots in the community and their occupants. It sets out what owners must do and what the association can enforce, covering property use, assessments, maintenance, and architectural standards.
- What you own & maintain: You own your lot (the land) and any house or improvements on it. You are responsible for all maintenance on your lot, including the dwelling, driveway, and landscaping, keeping it to the 'Community-Wide Standard.' The HOA maintains the common property — entry features, stormwater ponds, greenbelts, recreational facilities, and other shared areas. If your negligence damages common property, you can be specially assessed for repairs.
- Assessments & fees: The HOA can levy general assessments (annual dues, set by board budget), special assessments (for one-time costs, need 2/3 owner vote and Declarant consent), and specific assessments (fines, costs of owner default repairs). Upon first sale of a newly built home, a one-time $100 initiation fee is collected. Unpaid assessments become a lien on the lot and carry interest (up to 18% per year) plus late charges and collection costs.
- Leasing & rentals: Lots may be leased for residential purposes, but all leases must have a minimum term of six months. Before a sale or lease, the owner must tell the HOA the buyer's or tenant's name and any other info the board reasonably requires. Tenants must acknowledge and agree to follow the Declaration, Bylaws, and rules.
- Pets & animals: Only dogs, cats, or other usual household pets are allowed, in a 'reasonable number' as the board decides. No exterior pens are allowed unless approved under the architectural rules. No animals may be kept for any commercial purpose.
- Architectural review: No exterior construction, alteration, or addition — including painting, fences, landscaping changes, tree removal, swimming pools, play equipment, solar panels, or signs — may be done without prior written approval from the Architectural Review Committee (ARC) or Declarant. Interior remodeling does not need approval, but visible changes (like porch alterations) do. The ARC's approval is for appearance only and carries no liability.
- Parking & vehicles: Park only in designated spaces or your own driveway. On-street parking is not allowed (except for HOA-approved special events). Garage doors must stay closed except when entering or exiting. Boats, trailers, RVs, campers, and similar vehicles cannot be stored outside for more than 24 hours unless kept in a garage. Unlicensed or inoperable vehicles may be removed after 5 days.
- Use restrictions & nuisances: Lots are for residential use only. Home businesses are allowed only if completely unnoticeable from outside (no signs, traffic, noise, etc.) and do not affect insurance or security. No firearms (including B-B guns), no window AC units, no exterior clotheslines, no above-ground pools. Tree removal of trees over 4 inches in diameter needs approval. Wetlands and ponds are for drainage only — no swimming, fishing, or boating.
