This is an amended and restated declaration of covenants for Chateau Elan Country Estates, a single-family homeowners association (HOA) in Braselton, GA. It binds lot owners and sets rules for the residential subdivision. This document is a partial rulebook — it's the 'additional declaration' that incorporates and extends the original 1989 declaration, but the original declaration's full text is not included here.
- What you own & maintain: You own your lot and dwelling. You must keep your lot and dwelling in good repair, including the public right-of-way between your lot and the curb. The association maintains common property (streets, landscaping on common areas) and may maintain adjacent public rights-of-way if it chooses.
- Use restrictions: Each lot is for single-family detached residential use only. No business or commercial use is allowed. No subdivision of lots without association consent. All lots must have a dwelling with a double, enclosed garage; front-loading garages need developer approval. One-story homes must have at least 3,000 sq ft of heated space; multi-level homes at least 3,500 sq ft (excluding garages, porches, finished basements). Buildings must be set back at least 50 ft from front lot lines, 10 ft from side, 40 ft from rear, and 50 ft from golf course lot lines.
- Pets: You may keep dogs and cats as pets, but not for commercial breeding or sale. Pets must be under control when outside and owners must clean up after them.
- Parking & vehicles: No boats, trailers, RVs, trucks, commercial vehicles, motor homes, or mobile homes may be parked or stored unless completely out of view from streets, adjoining lots, and the golf course. Passenger cars may be parked only in the garage or driveway; guests may park temporarily on the street edge. No vehicles on lawns. Service/delivery vehicles may park in driveways or on streets during business hours.
- Architectural review: All exterior construction, alterations, or additions (including sheds, fences, satellite dishes, gazebos) must be approved in writing by the Architectural Control Committee and/or the association. Plans are deemed approved if no response within 30 days; you can appeal a disapproval to the board within 14 days. The ACC has the right to inspect your lot with reasonable notice.
- Assessments & fees: The association levies annual and special assessments equally on all lots. Special assessments over $250 per lot per year require approval of two-thirds of owners. The board can also levy specific assessments (e.g., fines) against individual lots. Delinquent assessments become a lien on the lot and personal obligation of the owner at the time they fell due. Late charges, interest, and actual attorneys' fees apply. You can request a statement of amounts due for a fee up to $10 (or higher if authorized by law).
- Leasing & rentals: This document does not expressly address leasing or rental restrictions. However, the original declaration (not included here) may have such rules.
- Golf course & adjacent lots: Lots adjoining the golf course are subject to easements for golf course maintenance, water flowage, golfer ball retrieval (on foot only, no carts), and landscaping approval by the golf course owner within 50 ft of the course. No fences, walls, or structures are allowed in that 50-ft area without golf course owner approval. Those lots have no riparian rights to adjacent lakes or water bodies.
