Montclair Homes Association is a standard single-family home HOA in Augusta, GA. These documents (protective covenants, charter, and by-laws) set the rules that apply to homeowners and residents of the Montclair subdivision. They cover what you can build, use, and keep on your lot, plus association membership and fees.
- Property use & allowed structures: All lots are for single-family detached homes only – no apartments, hospitals, or businesses. One-story homes must have at least 1,200 sq ft of main floor area (1,350–1,500 in some sections); two-story homes need at least 800 sq ft downstairs (900–1,000 in some sections). Minimum construction cost varies by section (from $11,000 to $15,000 based on 1960s cost levels). No trailers, mobile homes, or outbuildings used as residences.
- Setbacks & location of structures: No building within 10 feet of a side property line (some lots allow 8 feet). Rear yard setbacks: no residence within 25 feet of the rear lot line; pools and non-dwelling auxiliary buildings can be 10 feet from the rear line. Front setbacks follow the recorded plat. Corner lots have sight-line restrictions for fences and shrubs.
- Architectural approval: No structure, fence, or wall may be built without prior written approval from the developer (or its successors) of the plans, location, and facing direction.
- Pets & animals: No farm animals (poultry, swine, cows, horses, etc.). No more than two domestic pets (like dogs or cats) per lot, unless the developer gives written permission.
- Nuisances & maintenance: No dumping rubbish; trash must be in sanitary containers. No vehicle repair or messy hobbies visible from the street. No clotheslines in front of the house’s rear line. No exposed above-ground fuel or water tanks.
- Association assessments & membership: Each lot owner is a member and pays annual assessments set by the Board of Governors. The 1965 assessment was $25.20/year ($2.10/month), adjusted every five years by the Consumer Price Index. Assessments fund park/recreation area improvements and maintenance. Owners get one vote per lot; homeowners control the board after 75% of lots are sold.
- Recreational facilities & parks: Park areas (dedicated as 'Park' and 'Park #2') are for use by owners and residents of Sections I–V only – not the general public. The association may charge admission fees, and can suspend a member’s privileges for unpaid assessments (for any period) or for rule violations (up to 30 days).
- Leasing & rentals: Tenants may apply for voluntary association membership, pay the same annual dues as owners, and have one vote per occupied apartment. No more than 100 tenants can be members, and they cannot exceed 40% of total membership.
