What Riomar Sands Condominium Association, Inc.'s governing documents say
Riomar Sands is a condominium in Vero Beach, FL — you own your individual unit and an undivided share of the common elements, including beachfront property. The association manages the building and common areas, levies assessments, and enforces rules that apply to all owners, residents, and guests.
- Age restriction: No children under 12 years of age may be permanent occupants of any unit.
- Pets: Only one pet (cat or dog) initially; after that pet dies, only domestic cats and dogs under 10 pounds full grown, and birds, are allowed. All pets must be approved by the association and must be kept inside the apartment except when walked on a leash; they may not become a nuisance.
- Leasing & rentals: Leases must be for at least two months, and no owner may lease a unit more than twice in a calendar year. The association has a right of first refusal on any sale or lease (with exceptions for Developer and institutional first mortgagees acquiring title through foreclosure).
- Use restrictions: Each unit is limited to single-family private residential use. No clotheslines, signs, or exterior changes are allowed without prior written association consent. Nothing may be hung on exterior walls, doors, or windows.
- Assessments & finances: The association levies annual and special assessments based on each unit's percentage of ownership of common elements (ranging from about 3.05% to 3.87%). Assessments are due within 10 days; delinquencies bear interest at the highest rate allowed by Florida law and may result in foreclosure of the association's lien.
- Transfer restrictions: Except for Developer and institutional lenders who acquire title via foreclosure, any transfer of a unit by gift, devise, inheritance, or other means requires board approval. The association may purchase the unit at fair market value if it disapproves of the new owner.
- Architectural review: Structural modifications, removal of permanent interior partitions (except non-load-bearing ones), and any exterior changes require prior written association consent. No changes to the exterior appearance of the building or unit are allowed without approval.
- Parking: The condominium has 19 covered parking spaces, 44 uncovered spaces, and 30 storage spaces designated as limited common property. The Developer had the right to assign exclusive use of these spaces to specific units; after the initial assignment period, unassigned spaces revert to the association.
