Heritage Lake Association is a single-family home HOA in New Port Richey, FL. These rules apply to homeowners (lot owners) in the subdivision. The declaration covers what you can build, how you must maintain your lot, and your rights and duties regarding the private lake, roads, and amenities.
- Residential use only: Lots are for single-family homes only. No accessory buildings can be used as a residence, and no partially completed house may be occupied until the Environmental Control Committee deems it substantially complete.
- House size & setbacks: Minimum living space is 750 square feet (all on first floor for one-story; for multi-story, 750 sq ft on first floor). Minimum front setback is half the road width; side setback 10 feet; rear setback varies (50 feet from lake high water mark, else 30 feet or 25% of lot depth).
- Architectural review: All construction or improvements require prior written approval from the Environmental Control Committee. Plans must be submitted, and the committee may disapprove based on harmony with surroundings or general welfare. It can grant variances for hardship and charge a fee up to $30.
- Fences & exterior materials: Only visually non‑obstructive fencing is allowed, with size, location, height, and composition set by the committee. Exterior materials cannot be tarpaper, roll brick siding, or similar. Solar panels are allowed on roofs (max 50% coverage, must match roof color and be flush‑mounted), subject to state law.
- Construction deadlines & used structures: Construction must be completed within 6 months of starting. Structures damaged by fire must be repaired or removed within 3 months. No used structures are allowed; all must use substantial new materials.
- Lot maintenance & right to perform: Owners must keep lots mowed, debris‑free, and free of unsightly conditions, and must remove dead trees that are safety hazards. The association may enter to perform required maintenance and bill the owner.
- Septic & waste disposal: No outside toilets; septic systems must meet state/county health standards and be at least 50 feet from the lake. No sump pump discharge into the lake. Residential waste collection is exclusive to a contractor selected by the board; burning or burying waste is prohibited.
- Lakes & docks: The lake is privately owned by the association. No lot owner has riparian rights. Docks and piers must not extend more than 15 feet from low lake level and need committee approval. The association may change water elevation up to the high water mark (657 feet).
