This is the First Amendment to the Declaration of Covenants, Conditions and Restrictions for Lansing Ridge, a single-family-home subdivision in the Lansing Ridge II Homeowners Association in Melbourne (Brevard County), Florida. The document restates the complete set of rules that run with the land and bind all owners, setting requirements for construction, use, and maintenance of the roughly 203 lots in Phases IV-A and IV-B.
- Architectural review & construction standards: Before any building, alteration, or clearing, owners must submit plans, specifications, and a tree survey to a Review Committee for approval (at least 30 days before work begins), along with a $40 processing fee. The Committee may approve or reject for any reason, including purely aesthetic ones. Minimum dwelling size is 1,150 sq. ft. for a one-story or 1,000 sq. ft. for the ground floor of a multi-story home. Roof pitch must be at least 5/12, and garages must enclose at least two cars (no carports).
- Landscaping & tree preservation: No tree over 4 inches in diameter may be removed except for disease or if it directly interferes with the home’s placement. A minimum of seven native trees must be planted per lot – five in the front setback, two of which must be live or laurel oak, at least 6 feet tall. If any required tree dies, it must be replanted within 30 days. Owners must spend at least 1% of construction cost on front-yard plant material, and all lots must be fully sodded.
- Use restrictions & occupancy: Lots may be used only for single-family residential purposes. No business, trade, or commercial activity is allowed. One single-family home per lot. No subdivision of lots. No temporary buildings, trailers, or tents may be used as residences. Occupancy requires completion approval from the building authority and compliance with these restrictions.
- Parking & vehicles: Commercial vehicles (larger than a pickup), tractor-trailers, and commercial trailers may not be parked on any lot or street except for loading/unloading or inside a closed garage. Boats, motor homes, campers, and travel trailers must be stored out of street view or in a closed garage. Inoperable vehicles or vehicles under repair may only be kept in a closed garage.
- Pets & animals: No livestock, poultry, or commercial animal operations. A 'reasonable number' of dogs, cats, or household pets is permitted; the Association’s Board decides what is reasonable in case of dispute. No kennels.
- Fences, walls & structures: No fence, wall, hedge, or mass planting may exceed 6 feet in height, and nothing over 3 feet is allowed between the street and the front setback line without written approval. Chain-link, wire, and cyclone fences are prohibited. No fence may extend beyond the rear building line of the home, except for screening within that limit. All fences require approval.
- Assessments & fees: Every lot owner (Class A) must pay annual assessments and may be subject to special assessments for capital improvements. The initial annual assessment cap was $120 per lot (as of 1994). Caps may increase up to 10% per year without a membership vote; increases above 10% require a two-thirds vote of Class A members. A one-time special initiation assessment of $100 is due upon transfer of deed from the builder. Late payments accrue interest at 1.5% per month. Assessments are a lien on the lot.
- Violations & enforcement: The Association gives a 30-day written notice to cure a violation; if not cured, a fine of $50 per day begins to accrue (the Board may increase the fine without a vote). The Association may enter the lot to fix the violation, and the cost becomes an assessment lien. In any enforcement action, the prevailing party is entitled to reasonable attorney’s fees.

- All dwellings, structures, buildings, outbuildings, walls, driveways, fences must be maintained in good condition and repair by owner. Grass, hedges, shrubs, etc. kept trimmed; dead plants replaced. No accumulation of weeds, rubbish, debris (Article II, Sections 6 and 9)
- Voting & meetings
- Class A (each lot owner, excluding Declarant): one vote per lot; Class B (Declarant): three votes per lot owned. Class B converts to Class A upon above conditions. (Article IV, Section 2)
