About HOAs in Delaware
Delaware community associations are governed by the Delaware Uniform Common Interest Ownership Act (DUCIOA, 25 Del. C. Chapter 81) for associations created on or after September 30, 2009, and by older statutes for pre-DUCIOA condominiums and HOAs. DUCIOA sets detailed requirements around the declaration, bylaws, member meetings, board elections, access to records, and proxy voting. Each Delaware association also adopts its own rules and amendments.
