This is the master Declaration for a planned community called Red Creek Ranch at Hatchet in Pueblo, Colorado, which is divided into two separate homeowners associations: the West Hatchet Association (Red Creek Ranch at Hatchet Property Owners, Inc.) and the East Hatchet Association (East Hatchet Ranch Home Owners Association, Inc.). The document establishes rules for all lots within the property—residential, agricultural, or recreational use—and covers minimum dwelling size, building materials, setbacks, assessments, and more. It applies to both the West and East sections, but some rules apply only to a specific association. This guide is for homeowners, buyers, and renters who want to understand the basic covenants that run with the land.
- Lot use & dwelling requirements: Lots may be used for recreational, private residential, or agricultural purposes only. Each lot can have no more than one single-family dwelling (minimum 1,500 sq. ft. of heated living area) plus a separate guesthouse. Manufactured, modular, and mobile homes are prohibited; all homes must be built on-site.
- Construction & design standards: Exterior walls must be quality materials (clapboard, wood, stone, stucco, or masonry) in natural or earth tones. No tar paper or tarred siding is allowed. All utility lines must be underground unless extraordinary conditions apply. Building setbacks are at least 30 feet from any lot line.
- Construction timeline: The exterior of any improvement must be completed within 18 months after the start of construction. If construction stops for 60 days without permission, the association may require removal of unfinished work.
- Temporary residences & storage: No pickups, campers, trailers, tents, or motor homes may be used as permanent dwellings. A mobile home may be used temporarily during construction of a permanent home for up to 6 months, with advance written notice to the association. Building materials may be stored only temporarily during continuous construction.
- Animals & fencing: All animals kept on a lot must be fenced within the boundaries of that lot. No hog farm or feed lot is allowed.
- Marijuana: Commercial (for-profit) growing, cultivation, harvesting, or curing of marijuana is prohibited within the West Hatchet Ranch community. Personal use growing in accordance with Colorado state law is allowed.
- Assessments & fees: Each lot owner must pay annual common assessments allocated equally among all lots (excluding Declarant-owned lots until the Transfer of Control Date). The maximum annual common assessment per lot was initially $150 (through 1997) and can increase by 75% member vote, but not exceed $300 per lot (or the maximum allowed by law to maintain exemption under the Colorado Common Interest Ownership Act). Special assessments may also be levied, capped at $300 per lot per year combined with common assessments.
- Vehicles & signs: Inoperative, stripped, or wrecked vehicles must not be parked where visible from neighboring property or streets unless fully screened. Permitted signs are limited to occupant identification/address signs, Declarant’s development signs, safety signs, and required legal signs.
