This is a condominium community in Denver, Colorado. This document is a collection policy, not the full set of community rules. It explains the steps, fees, and legal actions the Homeowners' Association (HOA) will take if you fall behind on payments.
- What this document covers: This is specifically the HOA's collection policy for delinquent assessments (monthly HOA fees) and other charges. It explains late fees, interest, payment plans, and the foreclosure process for unpaid assessments.
- What you can be charged for being late: Payments are due on the 1st of each month. After 30 days, a late fee of up to $25 per month (not per day) applies. Unpaid balances also accrue 8% annual interest. Returned checks can incur a $20 fee.
- Payment plans for delinquent owners: If you owe money, the HOA is generally required to offer you a payment plan that spreads the missed payments over at least 18 months, with minimum monthly payments of $25. You lose this right if you've already had a payment plan before or if you're an investor who acquired the unit through foreclosure.
- Foreclosure rules: The HOA can foreclose on your unit only if you owe at least 6 months' worth of regular assessments, after offering you a payment plan and sending required notices. Foreclosure is not allowed if the debt consists only of fines, collection costs, or attorney fees without unpaid assessments.
- Language preferences and designated contacts: You can submit a written request to receive delinquency notices in a language other than English (the notices will be bilingual). You can also name a designated contact who will get copies of all delinquency correspondence.
- What this document doesn't cover: This is a supplementary collection policy. It does not cover day-to-day rules like pet limits, rentals, parking, or architectural changes. Those rules are in separate documents (the Declaration, Bylaws, and Rules & Regulations).
