What Callicotte Ranch Owners Association, Inc.'s governing documents say
This document is the Amended and Restated Bylaws of the Callicotte Ranch Owners Association, a homeowners association (HOA) in Carbondale, Colorado. It governs the internal operations of the HOA—how the board is elected, how meetings are run, how assessments are collected, and how rules are enforced. This document does NOT contain the property-use rules (covenants), architectural guidelines, or specific fee amounts; those are in separate documents.
- Community type & who it binds: Callicotte Ranch is a standard single-family-home subdivision HOA (the bylaws refer to 'lots'). The rules bind every lot owner in the subdivision. There is no age restriction, condominium structure, or rental-affordability program described here.
- Board & meetings: A board of 3 to 7 directors runs the association; directors serve one-year terms. An annual meeting is held after April 30. Owners get one vote per lot. Special meetings can be called by the board or by owners holding one-quarter of the votes. Meetings are open to all owners.
- Assessments & late fees: The board sets regular monthly assessments. Assessments are delinquent if not paid within 15 days of the due date. Interest accrues at 18% per year (current board-set rate) on delinquent amounts. Late fees are set at $0.00 (appears to be a placeholder). Returned checks incur an unspecified charge.
- Collection & foreclosure: Before collections, the association must send a notice of past-due amount and offer a one-time payment plan of at least six months. Foreclosure can begin only after the balance equals or exceeds six months of assessments (including interest, fees, fines, and legal costs) and the board votes to approve it.
- Rule enforcement & fines: The board investigates written/phone complaints. If a violation is found, the owner gets 15 days to fix it, submit a plan, or request a hearing. Fines are $0 per occurrence per day (appears to be a placeholder). After 60 days, the board can suspend owner privileges (common-area use, voting rights) and take legal action.
- Reserve fund investing: Reserve funds must be invested conservatively—only in U.S. Treasury bills/notes, money market funds, and certificates of deposit. Derivatives and mortgage-backed securities are prohibited. Safety of principal and liquidity are the primary objectives.
- Records & owner inspection rights: The association must keep meeting minutes, financial statements, insurance policies, budgets, and a list of delinquent assessments. Owners can inspect and copy records during business hours by making a written request at least five days in advance, for a proper purpose.
- What this document doesn't cover: This is a procedural bylaws document. It does not contain specific use restrictions (e.g., parking, pets, landscaping, architectural review), lease terms or rental caps, amenity access rules, or any specific fee amounts (other than the placeholder figures). Those are in the Declaration of Covenants or separate rules.
