What Vic's Landing Association's governing documents say
Vic's Landing Association (Breckenridge, CO) is a standard homeowners' association (HOA). These documents are board-adopted policies that describe how the board will create rules, resolve disputes, invest reserve funds, collect contact information, and plan for long-term repairs. They do not contain the core deed restrictions or rules for residents (like pet limits, leasing, or parking).
- How rules are made: The board may adopt policies after giving owners at least 30 days to comment and posting the proposal on the agenda for a board meeting. In an emergency, the board can skip the comment period. Owners must be notified of any adopted policy, and the board can deviate from this process if it's reasonable.
- Dispute resolution (ADR): The association encourages mediation or arbitration before going to court, but it is not required — especially for covenant enforcement, collections, or foreclosure. If both parties agree to ADR, they must pick a mediator familiar with community associations. The cost is split equally, and if the owner fails to pay, that amount becomes an assessment against the unit.
- Reserve fund investments: The board invests reserve funds with a focus on safety of principal, liquidity, low costs, diversification, and competitive returns. All investments must be FDIC-insured or backed by the U.S. government unless the board approves otherwise. The board may hire an investment counselor, and it must review the portfolio periodically.
- Contact information registration: Owners and their designated contacts are asked to provide a phone number, cell number, and email address so the association can meet Colorado's notice requirements when collecting unpaid assessments. It is the owner's responsibility to keep this information current.
- Reserve study policy: The association has not yet done a baseline reserve study. Once it does, the study must include a physical analysis (component inventory, condition assessment, replacement costs) and a financial analysis (funding plan). The study must be reviewed every 5 years, replaced if clearly not feasible, and funded through assessments so the reserve always has a positive balance.
- What this document doesn't cover: These documents are internal board policies. They do not contain the community's actual rules about pets, leasing, parking, architectural changes, age restrictions, or the amount of assessments. Those rules would be in the recorded Declaration, Bylaws, or separate rules and regulations.
