What Pala Rancho Cabana Club's governing documents say
Pala Rancho Cabana Club is a community for single-family homeowners in San Jose, CA. The rules here come from two documents: the club’s Bylaws (which govern membership in the Pala Rancho Cabana Club) and a Declaration of Restrictions (CC&Rs) recorded in 1965 that run with the land in Tract 4078 (and later, adjacent parcels). As a homeowner in this tract, you automatically become a proprietary member of the club, and you and your household may use the club’s facilities. The club is run by a Board of Directors elected by members, and the CC&Rs set basic residential standards and give the club the power to assess dues for maintenance of common facilities.
- Membership & who can use the club: Owners of lots in Tract 4078 and certain adjoining parcels are automatically proprietary members (one membership per lot). Only natural persons age 18+ may be members; firms or corporations may also own lots. The member’s household residents enjoy the same club privileges. If you lease your home, the tenant becomes the member for the lease term, and the membership reverts to you when the lease ends.
- Annual dues & assessments: The Board prepares an annual budget and sets dues to cover operating expenses and capital improvements. The maximum annual dues per lot was raised over time; as of 2016, the limit is $300 per year, and beginning in fiscal year 2020, dues are adjusted annually based on the U.S. Cost of Living Standard. Any increase beyond the current limit requires approval by a majority of the total membership. Special assessments above the annual budget also need majority member approval.
- What you can build & modify (CC&R restrictions): Lots are for single-family detached dwellings only, max 2½ stories, with a private garage for up to two cars. Minimum dwelling size: 900 sq ft for a one-story home, 1,500 sq ft for more than one story. Minimum lot width at building setback is 60 feet; minimum lot area is 6,000 sq ft. Setback rules: no building within 20 feet of front lot line, 12½ feet of side street line, 5 feet of interior lot line, or 20 feet of rear lot line (eaves, steps, and open porches don’t count toward these). Construction plans must be approved by an architectural control committee.
- Other property rules (CC&Rs): No noxious or offensive activity; no temporary structures (trailers, tents, shacks) used as residences; no signs visible from the street except one small professional sign (1 sq ft) or one for-sale/for-rent sign (5 sq ft) and builder signs during construction. Dogs, cats, and household pets are allowed, but not for commercial breeding or keeping. No livestock or poultry. Garbage must be kept in sanitary containers. No oil drilling or mining. Sight lines at intersections must be kept clear (no fences, walls, or hedges between 2-6 feet high within 25 feet of the corner).
- Leasing & rentals: If you lease or rent your home, your membership transfers to the tenant for the term of the lease. The tenant then has the right to use club facilities and must follow club rules. There is no stated minimum lease term in these documents.
- Enforcement & fines: The Board can fine members up to $50 per infraction (other than nonpayment of dues) and suspend privileges (other than for nonpayment) for up to 30 days, after notice and a hearing if requested. For unpaid dues, a 10% penalty is added, and after 15 days of delinquency the member is notified; if unpaid after another 15 days, the member is suspended and the club may sue to collect, including enforcing a lien under the CC&Rs.
