Nellie Gail Ranch is a planned unit development (PUD) in Laguna Hills, CA — a single-family home community with shared common areas, including equestrian trails and bike trails, managed by the Nellie Gail Ranch Owners Association. This Declaration of Restrictions establishes the covenants, conditions, and restrictions that run with the land and bind all lot owners, their heirs, and assigns.
- What you own & maintain: You own your individual residential lot and any buildings on it. The Association owns and maintains the Common Area (equestrian trails, bike trails, parks, open spaces) and is responsible for landscaping, utilities, insurance, and fire protection in those areas. Lot owners are personally obligated for assessments and cannot waive liability by not using the Common Area.
- Architectural review: No building, structure, exterior addition, or alteration (including painting, remodeling, or refurbishing) may be started without prior written approval from the Architectural Control Committee. Plans must be submitted showing design, materials, colors, and location; approval can be withheld for lack of harmony with surrounding structures. If the Committee does not act within 30 days, approval is deemed granted.
- Parking & vehicles: Inoperable vehicles must be kept inside a garage except for emergency repairs. Boats, trailers, horse trailers, mobile homes, RVs, campers, and trucks cannot remain on the property for more than 48 hours unless stored in a garage or otherwise unexposed to view. No vehicle (except lawn equipment) may be operated on walkways or sidewalks. Garages cannot be converted into living or recreational space.
- Assessments & fees: Annual assessments cover Common Area maintenance, utilities, landscaping, insurance, and other operating expenses. The maximum annual assessment can increase up to 10% per year without a membership vote; increases above 10% require 51% member approval. Special assessments for capital improvements exceeding 5% of the budgeted gross expenses also require a majority vote of non-Declarant members. Delinquent assessments accrue 10% annual interest and can result in a lien and foreclosure.
- Membership & voting: Each lot owner automatically becomes a member of the Association, with one vote per lot owned. The Declarant (developer) holds a separate Class B membership with three votes per lot, which converts to Class A once certain milestones are met (e.g., when Class A votes equal Class B votes, or by the fourth anniversary of the first public report).
- Common Area & easements: The Association owns and maintains Common Areas including equestrian trails and bike trails shown on Tract 9292. There is an express equestrian easement over certain lots for the benefit of members. Additional utility, drainage, and maintenance easements exist over adjacent lots, and the County has easements for fire safety, law enforcement, and public service access.
- Fire prevention: A Fire Prevention Committee works with the County to set rules for weed abatement and land use within designated Fire Hazard Reduction Regions (approximately 30-foot wide strips on many lots). Construction and agricultural uses in these regions require consent from the Committee and/or County Fire Protection Department.
