Providence at Sheely Farms is a single-family-home HOA community in Phoenix, Arizona, governed by a Declaration of Covenants, Conditions, Restrictions and Easements recorded by builder KB Home Phoenix Inc. This document binds all current and future owners, occupants, and tenants, and establishes a homeowners association to maintain common areas, enforce rules, and collect assessments.
- Architectural review: Any exterior change visible from neighboring property (landscaping, fences, paint, sheds, solar panels, antennas, etc.) requires prior written approval from a Design Review Committee. Applications not responded to within 60 days are deemed disapproved. The committee may charge a reasonable review fee and hire consultants.
- Leasing & rentals: No lease may be for less than 30 days. Each owner must lease their entire lot (no partial leases). The owner is responsible for tenant compliance with all HOA rules. Tenants are subject to the same declaration and rules.
- Parking & vehicles: Only private passenger automobiles and pickup trucks up to 1 ton capacity, 84 inches tall/wide, and 228 inches long may be parked on driveways. No commercial vehicles, RVs, boats, trailers, or non-operational vehicles may be parked outside an enclosed garage. Garage doors must stay closed except for entry/exit.
- Pets: Only a reasonable number of common house pets (as determined by the board) are allowed, kept as domestic pets only. No poultry, livestock, or animals kept for commercial purposes. Pets that become an annoyance or obnoxious may be prohibited.
- Animals and nuisances: No nuisance, offensive odor, loud activity, or anything interfering with quiet enjoyment is permitted. The board may decide in its sole discretion whether a violation has occurred.
- Assessments & fees: Annual assessments are levied per lot, with a maximum annual increase tied to CPI or 20%, whichever is greater. Special assessments require 2/3 member vote. A transfer fee and a working capital fee (1/6 of current annual assessment) are due upon purchase. Assessments are a lien on the lot.
- Use restrictions: All lots are for residential use only. Limited home-based businesses are allowed if not detectable from outside and compliant with zoning. No signs except small address signs, one for-sale sign (max 6 sq ft), and builder signs during development. Clotheslines are allowed only if not visible from neighboring property. No basketball goals except as permitted by rules.
