What Aquila Mcdowell Mountain's governing documents say
This is the Condominium Declaration for Aquila McDowell Mountain, a commercial condominium in Scottsdale, AZ. It establishes that units may be used exclusively as offices for professional services (e.g., medical, legal, architectural) or other uses approved by the Board (during the Period of Declarant Control) or all Unit Owners (after that period). This document binds unit owners (who own their unit plus a share of common elements).
- Allowed use & restrictions: Units may be used only as offices for professional services (including medical, dental, legal, architectural, accounting, real estate, insurance, title/escrow, and related sales). Other uses require Board approval (during Declarant control) or unanimous Owner approval (after). No antennas, satellite dishes, or similar outdoor devices without written Board approval.
- Changes & alterations: Nonstructural interior alterations do not require Board approval, but no changes affecting the exterior appearance, perimeter walls, or party walls may be made without prior written Board approval. Structural alterations require Board approval and a licensed Arizona engineer or architect's certification. The Board may require security deposits, insurance, and plans. The owner must indemnify the Association for any damage.
- Pets: No animals, birds, reptiles, fowl, poultry, or livestock may be kept in any unit or on the condominium property, except fish in aquariums.
- Parking & vehicles: Each unit is allocated a covered parking space identified on the plat. No vehicle repairs (except emergency), inoperable vehicles, or parking outside designated spaces. No mobile homes, trailers, campers, boats, or recreational vehicles may be kept on the property. The Association may tow violating vehicles at the owner's expense.
- Leasing & rentals: Any Unit lease must be in writing, acknowledge the lease is subject to the Declaration and Rules, and require the lessee to comply. The owner must provide the Association with lease start/end dates, lessee names, owner contact info, and emergency contact at least 10 days before occupancy. The owner is liable for lessee violations.
- Assessments & fees: Unit owners pay Common Expense Assessments based on a percentage of total costs (proportional to unit square footage). The Board adopts an annual budget and may adjust assessments mid-year if needed. Special assessments and enforcement assessments are also allowed. Assessments are personal obligations of the current owner and attach as a lien.
- Maintenance & insurance: The Association maintains, repairs, and replaces all Common Elements (including perimeter building walls, sprinkler and fire alarm systems). Each Unit Owner is responsible for maintaining and repairing their unit interior and allocated Limited Common Elements (such as dedicated utility fixtures and parking spaces). The Association carries master insurance for the building.
- What this document doesn't cover: This is an excerpt of the full Declaration; it omits any rules the Board may later adopt (Rules), and does not include the Articles of Incorporation or Bylaws. It does not specify assessment dollar amounts, insurance policy details, or a pet deposit. No information about amenities, age restrictions, or rental minimum term lengths is present.
