This document is a Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Western Skies Village Center, a commercial/retail shopping center in Gilbert, Arizona. It governs the owners (typically commercial property owners or investors) of Lots within the center, not residential homeowners or tenants. The rules focus on building design, use restrictions, maintenance of common areas, and reciprocal easements among the owners.
- Permitted & prohibited uses: Lots may be used only for retail, office, and service establishments common to first-class shopping centers. Prohibited uses include hotels, adult entertainment, industrial purposes, car washes (except the MFC Store), and sale of boats or vehicles. The MFC Store on Lot 2 has exclusive rights to sell motor fuel and provide automotive service.
- Building & design review: All building construction and exterior changes require prior written approval from Declarant and must comply with design guidelines. Buildings are limited to single story (with mezzanine) and 45 feet in height. A Design Review Committee may be established to enforce architectural compatibility.
- Common area maintenance & costs: Common areas (parking, landscaping, walkways) are maintained by a Maintenance Director appointed by Declarant. Each Owner pays a proportionate share based on Lot land area (percentages listed: Lot 1=12.73%, Lot 2=34.90%, Lot 3=11.98%, Lot 4=40.39%). The Maintenance Director may charge a service fee up to 10% of expenses.
- Leasing & occupant use: Owners may lease their Commercial Area, but all Occupants (tenants, subtenants, etc.) must comply with this Declaration. No minimum lease term is stated. Seasonal sidewalk sales are permitted on Lot 4 if promptly restored.
- Signage: All signs must comply with the Western Skies Village Center Sign Criteria. Pad monument signs on Lots 1, 2, 3 and store directory monument signs on Lots 1 and 3 are allowed, with construction and maintenance costs allocated among Owners as specified.
- Insurance requirements: Each Owner must maintain commercial general liability insurance with minimum limits of $3M per person/$5M per occurrence for bodily injury and $1M property damage (or $5M combined single limit). Common area insurance is maintained by the Maintenance Director with similar limits.
- Easements & access: Reciprocal easements grant all Owners, Occupants, and invitees non-exclusive rights for ingress/egress, parking, utilities, and service drives across common areas. Service Drives on Lots 1 and 4 provide access for Lot 4's service facilities and employee parking.
- What this document doesn't cover: This is a commercial shopping center declaration; it does not cover residential use, rental terms for homes, pet policies, or any residential association governance. It is an excerpt (Articles I–XI) of a longer document; later articles (e.g., Owners Association, amendments) are not included.
