Shamrock Estates is a single-family home HOA in Gilbert, Arizona. These Covenants, Conditions and Restrictions (CC&Rs) run with the land and bind all current and future owners, tenants, and visitors. The purpose is to protect property values and establish a uniform plan for the community.
- What you own & maintain: You own your lot and the detached single-family residence on it. Each lot is limited to one detached residence of no more than two stories, plus a private garage (1–5 cars). You are responsible for maintaining your lot and home, and the association maintains the common area (if any) and may also maintain certain rights-of-way and landscaping along streets.
- Use & occupancy rules: Only 'Single Family Residential Use' is permitted. A single family is defined as one individual; a group of two or more related by blood, marriage, or adoption; or a group of up to three unrelated persons (plus domestic servants) living together as a common household. No commercial activity is allowed, though home businesses consistent with local ordinances are permitted.
- Leasing & rentals: Lots may be leased, but no lease may be for less than 30 days. Tenants must comply with all governing documents, and owners are responsible for their tenants' violations. No 'for lease' signs visible from neighboring property are allowed during the first 24 months after the initial sale of a new home.
- Pets & animals: Only dogs, cats, and other common household pets are allowed, in numbers and breeds determined acceptable by the Board. No commercial breeding. Pets must be kept in a fenced yard or on a leash. No structures for animals may be visible from neighboring property.
- Architectural review: An Architectural Committee must approve all exterior improvements, changes, paint, landscaping, fences, and any other alteration visible from neighboring property, unless installed by the builder/declarant. Approval is deemed given if the committee does not act within 60 days of a complete application.
- Parking & vehicles: Parking is allowed only on driveways (not on front lawns). Vehicles over 250 inches long, 84 inches tall, or 84 inches wide are generally prohibited unless parked in a rear or side yard not visible from the street. Inoperable vehicles, commercial vehicles, and vehicles displaying business signage are restricted. Street parking is limited to daytime hours for oversized vehicles.
- Signs & displays: No sign visible from neighboring property is allowed without prior approval, except: a single 'for sale' sign (max 30"x24"), one political sign (max 24"x24") displayed no earlier than 45 days before and no later than 7 days after an election, and builder/declarant signs. No signs advertising a lot for lease are permitted. Holiday displays are allowed between Nov 1 and Jan 31 (or one week before/after other national holidays).
- Assessments & fees: Annual assessments start at $600/lot (maximum) for the first year, then increase by the greater of 10% or the CPI increase (with utility/insurance adjustments) but not more than 20% year over year without a vote. Special assessments require a 2/3 vote. A transfer fee (set by the Board) is due upon purchase. New home buyers must also pay an amount equal to 2 months of annual assessments into reserves. Delinquent assessments bear a late charge of the greater of 10% or $15, plus interest and attorney fees, and create a lien on the lot.
