Assessments & dues

The Replenishment Assessment is in an amount to be determined by CAWCD as necessary to allow CAWCD to perform its groundwater replenishment obligation under the Groundwater Replenishment Statute. CAWCD shall levy the assessment in accordanc (Sections 2.1, 2.2)

Collections & liens

The Replenishment Assessment, plus interest, costs, and penalties, constitutes a continuing lien on the Parcel and is also a personal obligation of the Owner at the time due. CAWCD has rights and remedies under A.R.S. §§ 48-3778 and 48-3782 (Article 3, Sections 3.1-3.2)

Amendments

This Declaration may be modified, amended, or revoked only (i) by express written agreement of CAWCD, the Department, and the Owners of 67% of the total area of the Property; or (ii) by amendment of statutes, rules, or regulations as contem (Section 4.2)
