This is the master governing document for Ahwatukee Board of Management, Inc. (ABM), a large master-planned community in Phoenix, Arizona. These Rules & Regulations and Bylaws apply to all homeowners, residents, tenants, and occupants within Ahwatukee. The rules focus heavily on exterior maintenance, landscaping, architectural control, parking, and vehicle storage — with strict standards designed to maintain a uniform, well-kept appearance across the community.
- Architectural review: Any alteration to the exterior of a home or lot — including painting with the same or different colors — must be submitted to the Architectural Review Committee (ARC) for approval at least three weeks before planned work. ARC guidelines determine approval. If your home is in a sub-association, submit requests to that association instead.
- Landscaping & yard maintenance: Yards visible from the street must be covered with rock, granite, groundcover, or grass — no dirt front or side yards. Dead trees, tree stumps, and tree debris must be removed. Weeds and volunteer growth must be removed. Grass must be mowed, edged, trimmed, and watered to stay green; bare spots are not permitted. Hedges along sidewalks cannot exceed 3 feet; hedges from the front plane of the house to the sidewalk cannot exceed 4 feet.
- Home exterior upkeep: Holiday décor may be displayed no more than 30 days before and 30 days after the event. Roof replacement requires prior ARC approval; missing shingles/tiles must be replaced with matching materials. Exterior surfaces must be painted in a uniform color and maintained to prevent chipping, peeling, or fading — prior ARC approval is needed for paint type and color. Internal window coverings (drapes, shutters, shades, blinds) are required; sheets, blankets, newspaper, and foil are not acceptable. Glass must be kept in like-new condition.
- Vehicles & parking: Inoperable or inoperable-appearing vehicles (flat tires, broken windows, expired plates, etc.) are not allowed unless parked inside an enclosed garage. Vehicles leaking oil or fluids must be parked in a garage or use an approved oil pan. Parking is only permitted on approved surfaces (poured concrete, concrete pavers, or brick); parking on common areas, landscaped areas, or vacant lots is prohibited. Recreational vehicles, utility vehicles, and trailers may not be parked in view of streets or neighboring lots except for 48-hour loading/unloading — no maintenance is allowed during that time.
- Non-owner occupied registration: All non-owner occupied properties must register occupants annually with ABM. A registration form and an $85 annual fee are due by March 1. A $100 penalty is assessed if not registered and paid by April 15.
- Assessments & fees: Annual assessments are due January 1. A $18 late fee is charged after January 15. If unpaid by March 1, a lien may be filed ($123 filing fee added). Unpaid accounts may lead to a Justice Court complaint with court costs and attorney's fees charged to the homeowner. A $25 fee applies to returned checks.
- Bylaws & governance: Membership in the corporation is limited to the record owner of each residential unit. Annual assessments are set by the Board. The Board consists of 9 directors elected by members, initially elected after the developer sells 90% of units. Members have one vote per unit. Special meetings may be called by a majority of members. The Bylaws may be amended by a majority vote of members present at a meeting with a quorum, or by unanimous vote of all directors (provided no increase in Board powers).
